Terms & Conditions

These Terms and Conditions are in place to ensure a clear, fair, and enjoyable experience for both Baked With Love By Abi and our clients. By placing an order, you acknowledge that you have read, understood, and agreed to the policies outlined below. These guidelines help set expectations regarding payments, orders, deliveries, and responsibilities, allowing us to provide the highest standard of service and product quality.

We encourage all clients to review this section carefully before confirming an order.

Order Confirmation & Payment Terms

Orders are accepted exclusively through our designated order form, online Signature Shop, email, or WhatsApp. Orders placed via any other channel will not be considered valid.

All orders are considered confirmed only upon receipt of a minimum 50% deposit of the total order value, paid via accepted payment methods. Accepted payment methods are cash and local bank transfer.

Orders placed less than fourteen (14) days prior to the required date, as well as orders from the Signature Shop, require full payment at the time of booking to accommodate procurement and preparation requirements.​​

The remaining balance on all orders must be paid in full at least three (3) days prior to delivery or collection. Failure to settle any outstanding balance may result in delivery being withheld and/or products not being released until payment is received. 

Cancellation & Refund Policy

All cancellation requests must be submitted in writing.

​

Cancellations made seven (7) or more calendar days prior to the agreed fulfilment date are eligible for a refund of payments made, less a fifteen percent (15%) administrative fee. This fee covers administrative processing and reservation of the production date.

Cancellations made less than seven (7) calendar days prior to the fulfilment date are not eligible for any refund, including deposits and additional payments. Due to the custom nature of our products, the perishability of ingredients, and advance preparation requirements, the fulfilment date is held exclusively for the client once this period has commenced.

Orders placed within five (5) calendar days of the fulfilment date, as well as orders from the Signature Shop, are non-refundable in full and are not eligible for cancellation refunds under any circumstances.

Delivery & Collection

Delivery is quoted as an additional fee based on location. Charges will be added to your total. A delivery time and location must be provided upon submission of your order request. We reserve the right to deliver the cake up until the event starts.

If you choose to collect your cake at our location, Baked With Love By Abi is not responsible for the cake once it is in the care of the client. Clients are responsible for transporting cakes according to the provided cake care guide.

While every effort is made to meet agreed delivery/collection times, Baked With Love By Abi is not responsible for changes in cake quality if collection or delivery occurs outside the confirmed timeframe.

Right to Withdrawal

Baked With Love By Abi reserves the right to withdraw from an order due to unforeseen circumstances, including but not limited to: non-cooperation, changes to location or facilities, unavailable times, non-confirmation of quote acceptance, or late payments.

In the event of withdrawal, all fees will be returned, excluding the fair market value of any services or products already provided.

Allergy and Ingredient Disclaimer

All products from Baked With Love By Abi are prepared in a kitchen that handles a wide range of ingredients, including nuts, wheat, dairy, eggs, soy, and other common allergens. As a result, we cannot guarantee that any product is entirely free from trace allergens or cross-contact, even if they are not listed in the specific recipe.

A notice indicating common allergens in your item is included on all packaging. It remains the client’s responsibility to inform all guests that the product may contain, or have come into contact with, allergens.

Clients are required to disclose any allergies at the time of ordering so that all reasonable measures can be taken to reduce potential risk. Despite these precautions, Baked With Love By Abi cannot be held liable for any allergic reactions that occur after the product has been collected or delivered.

Non-Guarantee

Although every possible care is taken with the delivery, setup, and handling of cakes, once delivered or picked up, the cake becomes the responsibility of the client. Baked With Love By Abi cannot be held responsible for any damage, destruction, or quality issues once the product is in the client’s care. Clients are responsible for storing and handling cakes according to provided instructions.

Photo Usage

We reserve the right to use any photographs taken of your product for marketing purposes, including our website, social media, or advertising materials.

​If clients provide reference images or inspiration, we reserve the right to adapt the design for practicality, safety, or ingredient availability, and this will be communicated. Exact replication cannot be guaranteed.

Creative Variation

We do not replicate other cake designers work identically, and reserve the right to any minor alterations on the design if we deem necessary. Please note that our creations are all hand made and no two designs, even if produced by the same person, are exactly alike.

Ornaments and Cake Toppers

Ornaments and cake toppers can be delivered to us 3–5 days before the event or left on the cake table for placement upon delivery. We will do our best to secure the item but cannot be held responsible if it falls off the cake. Please inform us ahead of time if we are to place any item so we can bring the appropriate tools.

Force Majeure

Baked With Love By Abi shall not be held liable for any failure, delay, or inability to fulfill orders caused by circumstances beyond our reasonable control (“Force Majeure Events”). Such events include, but are not limited to: natural disasters (e.g., hurricanes, floods, earthquakes), extreme weather conditions, fires, power outages, transportation disruptions, supply shortages, civil unrest, government restrictions or regulations, pandemics, serious illness, injury, or incapacity of key personnel that prevents the safe preparation, delivery, or collection of the product and cannot be mitigated by temporary replacement or staffing adjustments, or any other unforeseen event that renders it impossible, unsafe, or impractical to prepare, deliver, or collect the product.​

In the event of a Force Majeure Event:

  1. Notification: We will make reasonable efforts to inform clients promptly once the event occurs or is anticipated, and provide updates regarding potential impacts on the order.

  2. Rescheduling: Where feasible, we will offer the opportunity to reschedule the delivery or collection of the order to a mutually agreed date. Clients agree to cooperate in good faith to select an alternative date.

  3. Payment Handling: Deposits and payments are not automatically refundable. However, in good faith, payments may be applied toward a future order within a reasonable timeframe, subject to mutual agreement. Clients acknowledge that circumstances may prevent rescheduling in rare cases.

  4. Alteration of Product: Orders may need to be modified, simplified, or adjusted to accommodate the circumstances, including but not limited to changes in size, design, ingredients, or packaging. These changes will be made at the discretion of Baked With Love By Abi to ensure safety and feasibility and will be communicated to the client.

  5. Limitation of Liability: Clients acknowledge and accept that Baked With Love By Abi cannot be held responsible for any inconvenience, financial loss, diminished quality, or alteration to the product resulting from a Force Majeure Event. This includes, without limitation, circumstances affecting the availability of ingredients, delivery, collection, or the overall appearance or condition of the product.
